Legislation and the Secured Loans Market

Introduction

The Secured Loans market is often referred to as 'Unregulated' and this has led to organisations taking a rather laissez faire attitude to creating advertisements as part of their marketing campaigns? This article shows that regulation within the secured loans industry is very much alive. It will also briefly discuss the various Parliamentary Acts that incorporate legislation affecting the Secured Loans or Second Charges market and advertising. The target readership for the article is either those involved in the Finance Industry and marketing of specifically secured loans, or members of the public with a general interest in Consumer Credit legislation and advertising regulations which may affect them.

The Office of Fair Trading (OFT)

The Office of Fair Trading, or O.F.T as it is more commonly referred to, is responsible for a number of key areas with the ultimate aim of protecting the consumer. It has three main purposes. These are the enforcement of Competition and Consumer Protection rules, the analysis of markets to make sure they are working and communication to consumers, businesses and the government.

In terms of Secured Loans there are a number of areas the O.F.T deals with that affect the way that operators in the market promote themselves. The first of these is by administering Consumer Credit Licenses. With the rapid growth in people taking out credit in the early 1970s an act of parliament was passed in 1974 called the Consumer Credit Act and it is under this at that Consumer Credit Licences are granted. If an entity advertises promotes or brokers Secured Loans it must have a Category C Consumer Credit License. On application the O.F.T will investigate all people connected to the business applying to ensure that they are all people worthy of issuing or guiding people to enter into credit. There is a general misconception in the market that the Consumer Credit License is only required if the Secured Loans Company offers loans less than 25,000, but the Act clearly states that a Category C license is required for businesses that provide credit of ANY amount secured on land.

Other areas the O.F.T deal with that affects secured loans are there enforcement of other elements of the 1974 Act and also the updates to the Act which occurred in 2004 - these are the 'Agreements Amendment', 'Disclosure of Information' and 'Early Settlement' Consumer Credit Acts.

For secured loans these act govern a number of things. The first of which is the way that organisations can advertise secured loans. The Acts have rules governing what can and cannot be said in an advertisement and also have stipulation over certain words that have to appear in the advertisement. For example the words "YOUR HOME MAY BE REPOSSESED IF YOU DO NOT KEEP UP REPAYMENTS ON A MORTGAGE OR ANY OTHER DEBT SECURED ON IT" probably have to appear on most Secured Loans advertisements. The Acts also stipulate that the Annual Percentage Rate (APR) must appear on Credit advertising and also given rules give its calculation (commonly known as the TTC calculation or total charge for credit).

There is a growing momentum in the Mortgage and Secured loans industry that at some time secured loans will be regulated by the F.S.A. With the already increased workload of the F.S.A it is more likely that an 'official' recommendation for their regulation by the F.S.A is more likely to come from the O.F.T

Financial Services Authority (FSA)

The Financial Services Authority, or F.S.A as it is more commonly know, is responsible for enforcing the rules of the Financial Services and Markets Act 2000. Contrary to popular belief it is actually a non-government independent body and is financed solely from the income it receives from the very organisations it legislates. Although it is accountable to Treasury Ministers it is operationally independent.

In terms of legislation affecting Secured Loans the F.S.A regulates activities in relation to payment protection insurance (P.P.I). So if a business helps customers buy or claim on payment protection insurance it is highly likely it will need to apply to the F.S.A to be regulated. In the Secured Loans market whether you need to be legislated by the F.S.A largely depends on your involvement in P.P.I. If an organisation simply acts as an introducer it is quite likely it does not need to be regulated, however it is always advisable to seek legal advice.

Another area the F.S.A deals in that may affect Secured Loans providers is their regulation of Mortgages. The FSMA states that if an authorised lender gets second charge loans business from an unauthorised lender then their advertisements must be approved by the F.S.A approved firm.

Finance Industry Standards Institute (FISA)

The Finance Industry Standards Institute (FISA) is a self-governing body set up independently by the industry to govern itself in the Secured Loans market. An annual subscription fee from its members funds FISA. It publishes a Code of Conduct for its Members that cover the standards it requires in advertisements. In essence these are guidelines that give the requirements of the O.F.T specifically for the Secured Loans sector. FISA also publishes a disciplinary procedure and warns in its documentation that it will enforce legislation on non-members, in the first instance by contacting the offending organisation and in the second instance by informing the relevant regulatory body.

FISA also conducts training courses every month or so. These cover the legislative requirements of being involved in the Second Charge sector. In the future the organisation plans to have three levels of 'qualification', these will be Foundation, Associate and Member, but it is waiting on developments in the O.F.T and F.S.A before it does this. One supposes whether this happens will also be influenced by the level of regulation that those two bodies impose on the Secured Loans sector.

Information Commissioners Office (ICO)

The Information Commissioners Office (ICO) enforces the requirements of the Data Protection Act (1998). Given that all businesses in the secured loans sector will at some time hold information about individuals they must be registered as a Data Controller with the ICO. In summary, the Data Protection Act ensures that all data kept on an individual is accurate, fairly and lawfully processed, adequate relevant and not excessive, used for limited purposes, not sent overseas and is kept securely.

Other Regulatory Bodies and Secured Loans

Although the following organisations do not have a direct power or control over the secured loans market it is worthwhile mentioning them, not only for reasons of clarity, but also, as it is possible there will be changes in legislation, these organisations may later have more influence over the secured loans sector.

The Consumer Credit Trade Association (CCTA) is another independent body, but differs from FISA in that it deals with the whole Consumer Credit market. It also offers training courses, publishes regular newsletters and actively lobbies the Government about consumer credit related issues. In a world where we assume taking out credit is a relatively new phenomenon it is useful to note that the CCTA was founded well over a hundred years ago in 1891.

The Intermediary Mortgage Lenders Association (IMLA) is an independent body that represents the views and interests of institutions in the generation of mortgage business through Intermediaries.

The Council of Mortgage Lenders (CML) is yet another self-governed body operating in the Mortgage Industry. In a similar fashion to the CCTA it is also involved with government with legislative issues, issues policy guidelines. It is also renowned for produces statistics about the UK lending market covering, amongst other things, arrears and repossessions, the number of mortgages being taken out and specifics like the number of buy to let mortgages being taken out.

To finish this section there is one more independent organisation called the Association of Mortgage Intermediaries (AMI) who act as the trade body for mortgage intermediaries.

Although the Secured Loans sector is commonly referred to as 'unregulated' this document has hopefully shown there is still a lot of regulation (both official and un-official) that affects and encompasses the secured loans sector. In the finance area where the UK has a reputation for being the most regulated in Europe it is only a matter of time before secured loans come under the umbrella of the FSA. It is believed that instruction for the FSA to take control of the secured loans market is more likely to come from the treasury rather than the FSA itself. How to Make a Wellington Boot Rudolf

Want to make a Rudolf wellington boot Christmas decoration unlike any other? A smashing festive ornament, who you can help adoring.

To make a welly Rudolf you will need...

4 pairs of kids old wellies. Unless you are best friends with Snowhite and the seven dwarfs, I suggest that you look for wellies at your local car boot. You can pick up kids old wellingtons for around 20p to 75p. Don't be afraid to haggle. Try to pick wellies that don't have a raised image on the side, as this will show up on Rudolf later. I used wellies sized 10, 10, 7 and 3 (UK child sizes) Get what you can but try to get wellies of a similar size.

You will also need...

Thick card (the side of a grocery box is ideal) gold spray paint, string, newspaper, 2 glass stones, a red Christmas bauble, and Evo-Stick timebond adhesive or another glue which will stick rubber.

Firstly, give the wellies a good wash. Glue and paint wont stick properly with dirt in the way.

Arrange Rudolfs legs.

Use the smallest pair of wellingtons for the forelegs. Stand the boots side by side and make two small holes in both boots on the inside leg part. The holes in the boots need to line up. Apply some glue to stick the boots together and thread some string through the holes to tie the boots together for extra support. Keep the threading and ting of string invisible by doing it on the inside of the boots. It is a bit of a fiddle, but is important.

Use a pair of sized 10 boots for the hind legs. Put the heels together and the toes apart, just wide enough to nestle the forelegs in between. Make holes ready for tying the boots together as you did before and glue the hind legs together at the heel and to the forelegs wherever they touch. Tie the boots securely with string invisibly on the inside.

Leave the welly structure to dry for 24 hours before continuing.

To make Rudolfs back and tuffty tail, take a sized 10 boot and cut it down the back seam in a straight line. If you use a knife for this part, be very careful not to cut yourself. Cut a triangle wedge from the heel of the boot. This is to remove the stiff rubber that shapes the heel because it is too stiff to work with.

Stick Rudolf's back onto his legs.

Open the split that you cut at the back of the boot and slot over the tops of the legs with the toe of the back boot pointing upwards. Bring the top edge of the back boot round to the front legs. Make small holes in these corner flaps and in the front wellies at the tops and stick the back boot into place and thread string into the holes that you made and tie securely. These knots will be on the outside of the structure but will be covered later.

The neck and lower head.

With the other sized 10 boot, cut the back seam of the boot again but this time only cut down to the top of the heal shaping. Turn the boot upside down and open the back split, slot the boot over the top of the front legs, with the shaping of the heel resting on Rudolf's back. Glue into place and anchor with parcel tape to hold the position until the glue dries. You may find that it helps to leave Rudolf to dry for 24 hours on his size. Remove the tape once the glue is dry.

Rudolf's head.

With a sized 7 welly cut down the front and back seams of the welly to the top of the heel and foot shaping. Cut ear shapes from the two flaps that you have just created.

Cut out two simple but chunky antlers from thick card. Do not put bends in the cardboard structure as you cut the antlers out. Make the antlers wider at the bottom, this help support the antlers later.

Push the antlers into the 'head' boot so that the base of the antler touches the sole of the boot. Scrunch up a sheet of newspaper and push it between the antlers to separate them and to wedge them in.

Make tow small cuts to form an 'X' in the toe of the boot and cut the flaps of the X away for make a circle ready to add the nose later.

Stick the top of Rudolf's head to the rest of the structure and leave to dry.

Spray paint the reindeer gold. Read the back of the paint tin and follow the manufactures advice of how to use the spray paint. Give the reindeer a coupe of coats of paint and be sure to cover all the nooks and crannies.

When the paint is completely dry, pull the end off the Christmas bauble and stick it into place with the bauble stork pushed through the hole in Rudolfs nose. Finally, stick two glass stones in place for Rudolfs eyes.

Rudolf can be scaled up to make a garden decoration by using adult wellingtons. Put a brick or stones inside each of Rudolfs feet to prevent him from falling over or blowing away in the wind.

Because the dimensions of adults boots are different to childrens boots, a large Rudolf's back legs can be positioned in a similar fashion to the front legs.

Paint and use a small ball for the nose. Half and paint a Ping-Pong ball for his eyes and fashion antlers from Wire coat hangers and bind with tinsel.

The Case For Complementary Currencies

Over the past few years we've seen that many local currencies have come into existence.

Let's first take a look at what a local currency is, and then follow the story why they mushroom now.

A local currency or a complementary currency is used as a medium of exchange among participating of a local group. The members of the group share the same economic interest: they wish to broaden the economic basis of the region they live in, and they wish to broaden the basis of the businesses they run. Local currencies may come in the shape of coins and notes just like the ones issued by the Central Bank, or they may be completely virtual, like credit and debit entries of a barter exchange. Also, they may be digital, like for instance digital currencies, backed by precious metals.

The common feature of all the local interest groups is to find ways and means to overcome the flaws of the monetary system in existence.

In the current monetary system there are two flaws.

First of all, the current monetary system allows private individuals or private companies to charge interest on loans to others.

Today there are huge inconsistencies in the value of global production, debt and assets.

In an environment of tougher competition prices drop. With falling prices risks are on the rise that borrowers will default on loan repayment.

Another feature of the current monetary system is the fact that it is not cash flow safe. The bearer of an amount of cash may prefer to hoard his cash. We humans are as creative on the "Dark Side" of commercial activity as we are in developing beneficial new products and services. In the face of huge financial benefits, however, some corporate executives can't resist taking an extra dessert even before their shareholders have finished dinner. 1) Variable Insurance and Annuities: Variable products are a relatively new thing in the insurance industry, circa 1980 or so. Before that, the conventional wisdom labeled the Shock Market much too risky for Life Insurance Policy and Annuity Contract guaranteed benefits. In fact, these benefits had been "guaranteed" for so long that it became a generic expectation of anyone in the market for either. So why did the State Insurance departments cave in to the Variable Product lobby? And what is not emphasized as these products are marketed to potential insureds and annuitants?

As if the 8% sales commission on Straight Life Annuities wasn't enough, the addition of Mutual Fund bonuses made the Variable Annuity irresistible... to financial professionals. Similarly, this product is so lucrative for the companies that they manipulate their rates to become more competitive. Since the introduction of variable benefits, there have been more insurance company failures and scandals, and not just a few disappointed recipients of reduced annuity payments. What's in your retirement plan?

2)Wrap Fee Investment Accounts: From the very beginnings of wealth, the very wealthy employed Investment Managers to protect and to grow their portfolios. Most Investment Managers had just a few huge clients that they tended to while the rest of the fledging financial industry focused on property protection and estate creation through life insurance. Most of today's (salaried) Investment Managers are employed by Financial Institutions to supervise thousands of Mutual Funds for millions of investors of all financial shapes and sizes. There are more Equity Mutual Funds than there are individual Equities on the New York Stock Exchange. Most investors today will employ many Investment Managers and never actually speak to any of them.

Enter the personally managed investment portfolio product offered by most major Financial Institutions. 3)Portfolio Window Dressing: Every quarter, every year, we hear about the adjustments that portfolio managers are making as they attempt to look smart to their largest clients. Now in a discipline (Investing) that they all officially recognize as a long-term commitment to some specific strategy or plan, why do the Masters of the Universe spend so much time manipulating their short-term performance numbers? And why is this considered business as usual instead of common fraud?

4)Asset Allocation Mutual Funds: I look at Asset Allocation a bit differently than most professionals seem to and I regulate and monitor a portfolio's structure using the cost basis of securities rather than their Market Value. But how, logically, can a one-size-fits-all Mutual Fund be the right mix for all investors? Here's a definition found on the Internet: "A mutual fund that rotates among stocks, bonds, and money market securities to maximize return on investment and minimize risk". And a definition of Asset Allocation from a similar source: "The practice of distributing a certain percentage of a portfolio between different types of investment assets, such as stocks, bonds, mutual funds, cash, real estate, options, etc. By diversifying an individual's asset base, one hopes to create a favorable risk/reward ratio for a portfolio".

In reality, Asset Allocation is a structure-planning tool that determines what percentage of an Investment Portfolio is to be invested for Growth in Equity securities and what percentage is to be invested for income production. The proper allocation is a function of the investor's age, marital status, financial position, employment status, retirement plans, expenditure needs, risk tolerance, family responsibilities, etc. Diversification occurs within the two (just two) asset classes. One size fits all... who's kidding whom?

5) Corporate Executive Compensation: I strongly believe that everyone has the right to become filthy rich, legally of course. I respect anyone who gets there honestly because their success creates jobs, opportunities, wealth, and a higher standard of living for everyone. But, once they sell shares of their successful enterprises to the public, they have a responsibility to share future profits and growth. Obscene executive suite compensation (right down to the chauffeured limousines) is simply stealing from shareholders.

With every new Scandal, a voracious Media and a hypocritical Congress exacerbate the fear of shocked investors and call for more regulation of the very entities whose success, freedom, viability, and competitiveness they should be nurturing. Ironically, politicians are always the most outspoken critics... probably because of their familiarity with cover-ups and improprieties. But no one ever questions the integrity of the Financial Institutions that invent, produce, price, and promote products and services that do far more long-term harm than the few (albeit serious and sensational) incidents of corporate wrong doing.

College Admission

The college application is the primary resource for admissions departments to determine a students worthiness for acceptance. This application is the only opportunity students have in presenting themselves in the best light possible, in hopes of gaining admission. Many will say that completing the application is a test in-of-it itself. We agree. This simple test determines how detail oriented students are and how well they follow instructions. In any give year, colleges receive thousands of applications for admission from prospective students, all competing for the same seat.

In order to help students submit an error free university application, weve asked admissions officers across the country what common mistakes do students consistently make on applications. Check out the major blunders:

1. Students do not read the directions carefully to make sure they understand what items are needed in order to complete their application. Recommendation: Before beginning the application read through it for understanding.

2. Students write the wrong social security number or use different numbers on different pieces of information. Recommendation: Carefully copy your social security number from your card.

3. Students use the wrong college address labels.

4. Students applying for regular decision but checked early action.

5. Students use the online application but fail to request information from their high school counselor.

6. Students have questionable remarks and photos of themselves on social network sites, like MySpace, FaceBook and others (a recent problem).

7. In the college essay students exceed the number of words required. Recommendation: If you need to write a 500 words essay it must be 500, not 500+. Colleges test your ability to communicate your thoughts with clarity and concision. They want to see that your writing flows and is methodical.

8. Students miss the application deadline. Recommendation: After choosing which institutions you would like to apply to, write down the application deadline dates on a calendar or in a personal planner. Cross off the names of the colleges as you submit your application.

9. Students take ACT or SAT in the spring of their senior year. Recommendation: Tests should be taken in your junior year or fall semester of your senior year to ensure that test scores will be released on time to apply for the September semester. Also, when you take the SAT or ACT early, you can retake the test if the scores are unsatisfactory.

10. Students send in application but do not send high school transcripts. Recommendation: Make a check list of documents that will accompany your application.

11. Students copy or buy essays from the internet. Recommendation: Do not plagiarize essays. Write your own essay. If you are copying essays from the internet then most likely another student will do the same. Getting caught is risky and not worth it.

12. The students parent fills out the application. Recommendation: You are the one seeking admission into college, not your parents. Therefore, you should be the one to complete the application.

13. Activity list is full of ambiguous acronyms. Recommendation: Do not use acronyms. Spell out each word. Just because you know what the acronyms mean, does not mean others will.

14. Students expect long list of activities to overshadow actual academic work. Recommendation: Instead of joining an array of clubs, extensively participate in one or two activities. Admissions officers are not looking to see how many activities you sign up for as much as your role in each extracurricular.

15. Students provide incorrect email addresses / telephone numbers.

16. Students forget to sign and date the back page of the application or have their parents sign it.

17. Students misspell their intended major: psychology and business are the most misspelled.

18. Students are careless in filling out the application and make typos, grammatical errors or have sloppy handwriting. Recommendation: Illegibility/poor penmanship can create problems, especially handwritten essays. Do not handwrite essays unless the application specifically requests you to. Otherwise, type them on a computer and attach the printed page to your application. If your handwriting is poor, consider applying online.

19. Applications folded 10 times to fit in a small envelope look bad. Soda/coffee stains, and dirty or sticky pages, torn/ripped edges all can affect your eligibility. Recommendation: Mail your application package in a legal size envelope. Also to be careful, DO NOT eat while completing your university application.

20. Students use pencil when filling out an application. Recommendation: Use a blue or black ink pen.

21. Some applications ask for County and/or Country. Recommendation: Read carefully! Do not mix these up.

22. Many students who have jobs do not mention them on applications. Recommendation: Often, these jobs impact the time students have available for activities. Include this information to paint a full picture of your out-of-school activities.

23. Students send the wrong essay. Sometimes students mix up college essays and send an essay intended for one university to another college.

24. Students do not address the essay question / topic. Recommendation: If you are not sure, ask your counselor for clarification.

25. For online applications, students slip the mouse and click on the wrong item in a drop down box. (It is amazing how many students say they're from Afghanistan -- which is usually listed right after United States on drop-downs for countries)

26. Students substitute thesaurus words for more colloquial phrases. Recommendation: Bright teens do not and should not write like their parents. Applications that stand out do not have the above problems. They "tell" rather than "show."

27. Students list "Hanging out with friends" or "talking on the phone" as an extra curricular activity. Recommendation: For those who do this, hanging with friends and talking on the phone are not note-worthy activities. Ask your counselor if you are not sure what to include.

28. Students blame a teacher in their personal statement for bad grades. Recommendation: Colleges care more about what you did about the bad grade than why you received it in the first place. Did you ask for extra help? Repeat the course? Get a tutor?

29. Students turn in essays with numerous misspellings and grammatical errors. Recommendation: Proofread and ask your counselor or teacher to read it over. Remember that sometimes computers do not pick up errors that are spelled correctly.

30. Students do not inform their high school counselor that they are applying to colleges x, y, and z. Students fail to mention the necessity of submitting required forms by the certain deadlines. Recommendation: Tell your counselor which colleges you are applying to for admission.

31. Students do not send SAT or ACTs, OR assume later test scores will automatically be sent to same institutions as indicated in earlier tests. Recommendation: Each time taking the SAT or ACT, request the scores be sent to your institution of choice.

32. Information on student transcripts is not updated or incorrect. Recommendation: Check your name spelling, home address, phone numbers AND course names, grades, and credits received.

33. Many colleges that use the Common Application also have supplements. Students forget to complete the supplement.

34. Students write generic essays. Recommendation: Relate your essay to yourself. Write details that are unique to you and that only you could have written.

35. Students list e-mail address that are in bad taste or vulgar. Recommendation: Be aware of the impression your e-mail address makes. Create a "professional" e-mail address for college and job applications. Offensive e-mail addresses make a bad impression.

36. Students do not ask a teacher or advisor to review their application before submission. Recommendation: After completing your application, ask your parent or your high school counselor to proofread it for you. Always have a fresh eye look at your application. Doing so will help eliminate the above mistakes.

What You, Worry?

I am always amused what people are worried about nowadays.

How they look in a mirror, their clothes, their style, what type of car they drive, how they have the right bracelet, to match the right earrings, to go with the stylish ankle bracelet, down to the matching toe ring.

Im serious here.

Or better yet, theyre worried about how many video games they are going to play today, how many movies they are going to rent, and how many bags of candy they can polish off in one sitting.

Too bad there is not enough focus on the many teen fitness concerns out there.

Ok, maybe Im focusing a little too much on you kids here (lol).

Unless, you parents are doing this too (lol).

Dont worry kids..many parents need to go to a adult fitness camp too

Worried to beat traffic, worry to get to work early, worry to finish everything at work so fast so you can get home quickly to drive your kids to softball, baseball, music, dance practices, then run home, shove down a greasy hamburger, fries, and your favorite carbonated beverage, then watch some TV, get heartburn, and go to bed.

Sounds like a great life, huh?

Sign me up!........just kidding, of course.

Unfortunately, what I have just written (or very close to it) is all too knowing for many people/families in this world.

Its sad really.

Its sad (to me at least) to see that people put SO MUCH IMPORTANCE on stuff like this and almost zero importance on their health and well-being.

Im about to give you a big secret

A secret that almost nobody (again, unfortunately) follows

You ready???

Are you sure??? (lol), OK.

*****Dont wait until its too late to worry about your health.*****

Profound, isnt it?

But so true.

So many people nowadays with all the hustle and bustle that goes along with everyday life: work, family, kids, stress, after-school activities, laundry, home repairs, mowing your yard, weeding flowerbeds, washing floors, doing dishes.how do you have time for your health?????

Answer: You make time for it.

So many things we do are of little importance, but yet we worry about them so much. Then, when one of our loved ones falls ill, or develops a disease, virus, etc., we all ask what went wrong? Invariably, it is everything that I have talked about in this article (at least to an extent).

So, what can YOU do?

Well, for starters, why dont you worry (not being paranoid, mind youmore like being aware of the situation) about your health and fitness.

Instead of worrying if your new shirt matches all 35 pairs of your pants.why dont you worry how you can make tonights dinner 50% healthier for you and your family.

Or worry how you can eat a more nutritious breakfast every morning (preferably not donuts and Pop-Tarts, washed down with a nice, tall sugar-laced beverage).

You see, making small changes like the ones I am suggesting do SO MUCH for your overall health and fitness, its not even funny.

I hate to start throwing out clichs, but as they say

An ounce of prevention is worth a pound of cure

Unfortunately, for some of you it should be An ounce of prevention is worth 20 pounds of cure.

Or maybe 40 pounds.

Heck, it might be 100 pounds.

The amount really doesnt matter.

What does matter is that you better get off your tail and hold yourself accountable for your health.

YOU can make better decisions.

YOU can make time for fitness (also, lets get off our butts, and help put a stop to all these teen fitness concerns).

YOU can lead your family by example.

Dont wait until you have high cholesterol, high blood pressure, clogged arteries..etc.

Why put yourself through all that pain and expense (time and money)???

Why dont you look ahead (and Im not talking about to tonights dinner), and gauge where you want to be at in 1 year, 5 years, 10 years.

Hint: your goal should be to be in the best shape you can possibly be in, at all times.

Dallas spent most of its television life in the Friday night time slot following the successful CBS series, The Dukes Of Hazzard.
